(Audubon) The Audubon City Council on Monday evening approved the third and final reading of the City’s new snow ordinance. This replaces section code 69-12 in its entirety.The ordinance reads as follows.
SECTION 1. SECTION MODIFIED.
Section 69.12 of the Code of Ordinances of the City of Audubon, Iowa, is replaced in its entirety with the following:
- Snow Emergency Declaration.
The Public Works Director is authorized to proclaim a snow emergency when appropriate and necessary. The general guideline for declaring an emergency is three or more inches of snow within any eight hours. - Public Notification.
The parking ban shall be applied uniformly. The City Clerk shall widely publicize all requirements and restrictions using all available news media, including Facebook, the City website, radio, other available signage, and text alerts when applicable. When predictions or occurrences indicate the need, the Public Works Director shall proclaim a snow emergency and notify the media. The emergency may be extended or shortened as conditions warrant. - Parking Restrictions During Snow Emergency.
When a snow emergency is proclaimed, no person shall park, abandon, or leave unattended any vehicle on any public street, alley, or City-owned off-street parking area if off-street parking is available, until snow has been removed or plowed and snowfall has ceased. Yard parking is allowed for 72 hours after snowfall has stopped. Parking is explicitly prohibited between 5:00 a.m. and 4:00 p.m. during the emergency, except when snowfall has ended and cleaning operations are complete.
If off-street parking is unavailable, vehicle owners shall have eight hours after the street is plowed to move vehicles at least 12 feet from the unplowed portion of the road. Any vehicle not moved within eight hours will receive a $75 fine, and any vehicle not moved within 24 hours will be towed at the owner’s expense in addition to the fine.
SECTION 2. REPEALER.
All ordinances or parts of ordinances in conflict with this ordinance are repealed.
SECTION 3. SEVERABILITY.
If any section, provision, or part of this Ordinance is adjudged invalid, unconstitutional, or unenforceable for any reason, the remaining provisions shall remain valid and enforceable.
SECTION 4. EFFECTIVE DATE.
This Ordinance becomes effective upon final passage, approval, and publication as provided by law.
