(Des Moines) KCCI News is reporting the U.S. Supreme Court has declined to hear a case brought by Shelby and Story counties, marking the latest development in a years-long legal dispute.
The counties sought to challenge the route of a proposed carbon dioxide pipeline, arguing they should have the authority to decide where it is built. County officials have said their local ordinances were intended to protect public health and safety.
Summit Carbon Solutions, which has proposed a multi-state carbon dioxide pipeline, has previously argued in court that federal law overrides the counties’ ordinances. KCCI confirmed the Supreme Court’s decision with the counties’ attorney in Washington, D.C.
In response to the ruling, Shelby County officials released a statement expressing disappointment:
“Shelby County was surprised and very disappointed by the denial by the U.S. Supreme Court to hear an important case addressing local control authority and protections. The Shelby County Board of Supervisors will be consulting with its legal counsel in the near future and weighing its options moving forward.”
