(Shelby Co.) The Shelby County Board of Supervisors has scheduled a public hearing on a proposal to repeal a zoning ordinance regulating hazardous liquid pipelines.
According to the meeting minutes, the Supervisors unanimously approved Resolution No. 2026-22 after a motion by Kolbe and a second by Schaben. The hearing will be held at 9:00 a.m. on May 5, 2026, at the Shelby County Courthouse in Harlan.
Ordinance No. 2022-4, adopted in 2022, restricted the use of land for hazardous liquid pipelines but was later challenged in federal court. Both the U.S. District Court for the Southern District of Iowa and the U.S. Court of Appeals for the Eighth Circuit found key provisions were preempted by federal law. With appeals exhausted, county officials are moving to repeal the ordinance.
The Planning and Zoning Commission previously recommended approval of the repeal following an April 7 public hearing.
Residents may provide comments at the May 5 hearing before the board votes on the proposed repeal.
In other business, the Shelby County Board of Supervisors voiced support for a proposed transport agreement between Audubon County Memorial Hospital and the Shelby County Ambulance Service. Hospital officials submitted a letter of intent indicating they plan to move forward with finalizing the agreement and requested the board’s support. Supervisors Parkhurst, Kolbe, and Schaben all expressed agreement in backing the proposed transport arrangement.
