(Atlantic) The Atlantic City Council on Wednesday held a public hearing and made a recommendation regarding the unbuilt Palm Street right-of-way proposal.
Bill Welter expressed interest in building a home on this property utilizing the west section of the Right-of-Way to access it. Welter also owns the property immediately west of the city-owned right-of-way.
Two homeowners at Wednesday’s meeting expressed concerns and claimed that allowing Welter to take possession of the right-of-way would diminish the enjoyment and use of their property.
Following a lengthy discussion, City Councilman Pat McCurdy recommended the city split the ROW three ways. Atlantic City Clerk Barb Barrick read the following recommendation.
The City Council had three options, take no action, direct City Administrator John Lund to facilitate access through the right-of-way with the Welters, or split the right-of-way evenly amongst the three property owners.
The six other council members unanimously agreed with McCurdy’s recommendation to split the ROW evenly amongst the three property owners and refer the request to the Planning and Zoning Commission.
In other business:
*The Atlantic City Council approved Weitzel’s Class C liquor license renewal. At the August 5th meeting, the City Council denied the request. Weitzel appealed the decision, and following a hearing, Administrative Law Judge Tricia A. Johnston ruled in favor of Weitzel and reversed the denial of its Class C liquor license. The Alcohol Beverage Division notified the city to put the liquor license back on the agenda for approval.
*Following a public hearing, the Atlantic City Council approved city-owned property at 301 Maple Street to Jamie Joyce, owner of JJ Design, LLC, for $10,000.00. Joyce plans to erect a building to expand his business with the purpose of warehousing, sign assembly, graphic application on vehicles, and business vehicle housing. The town requested sealed bids, and the Personnel and Finance Committee reviewed the proposals and recommended the sale to Joyce. Atlantic City Administrator John Lund says a dilapidated house once stood on this property, and the city demolished it.
The City Council also approved the following appointments: David Schwab, Atlantic Library Board of Directors, Bill Garrett, Atlantic Airport Commission, and Kyle Steffens to the Planning Zoning Commission.
