(Atlantic) Weitzel’s in Atlantic is filing an appeal after the City Council failed to approve their liquor license renewal.
The Liquor License Renewal was on the August 3rd City Council agenda and no motion was made for approval.
Atlantic City Clerk Barb Barrick explained during Wednesday’s City Council meeting that when the Alcoholic Beverages Division found out that the Council failed to approve Weitzel’s license, they sent a letter to Weitzel’s that basically stated that they received the notification that the renewal application was disproved by the City of Atlantic and the law requires that the administrator for ABD notify the applicant that they may appeal the local authority decision. Weitzel’s is allowed to continue to sell and/or serve alcoholic beverages during this appeal since Weitzel’s filed for the liquor license in time.
Barrick read the letter of appeal, which is public record. Jake Weitzel said he is appealing for a number of reasons.
Barrick noted that they have proof that notice was sent to Weitzel in June.
The letter of appeal continues…
Weitzel also mentioned in the appeal that upon driving around town it was noted that multiple businesses have grass and weeds growing on their properties, however, none have received the same level of repercussion of denial of licenses that he is aware of.
The next step is for the Alcohol Beverages Division to set a phone hearing and Jake Weitzel and the City will participate in that hearing and then the Administrative Judge will make the final decision.
Earlier in the City Council meeting Wednesday the Council approved a Class C Liquor License for Weitzel’s effective July 15, 2021 to July 14, 2022. Barb Barrick explained what happened in this situation….
