Summit is also battling Bremer County on similar arguments. They also presented arguments before the Iowa Supreme Court in October, and a decision is still pending.
In other news, the Iowa State Supreme Court is upholding a lower court decision against a Hardin County landowner who refused to allow pipeline surveyors onto his property. Summit Carbon Solutions is trying to get permits and permissions to run a carbon dioxide pipeline through several states. The Iowa Utilities Board has granted a permit for the pipeline, although Summit needs to get permits in all five states before they can begin construction. The Supreme Court decision is unanimous.
