Moore said this bill brought about a conflict of ‘do I vote for private property rights (limiting the use of eminent domain), or do I vote for the economic interests of the ethanol industry and the farmers who benefit from its enhanced pricing for the corn they produce’?
This bill will require a liquified carbon dioxide pipeline company to get voluntary easements for 90-percent of the affected route miles before being granted the right to use eminent domain. It also modifies how a landowner can bring a claim for damages. An amendment also established an Eminent Domain Interim Study which shall make recommendations that will improve eminent domain policy in the state.
