Supervisor Justin Schultz said it is important to note that the issue of whether or not eminent domain is to happen is not a county board of supervisor’s function regardless of the board’s opinion. The Iowa Utilities Board has the final say as to whether or not this will happen.

One visitor said one of the things they are running into in Shelby County is the number of places this pipeline would cross the water utilities.

The resolution states that while Pottawattamie County encourages business growth and development and recognizes the importance of ethanol facilities to the local economy, this particular type of pipeline should not be considered a public utility. The resolution says Pottawattamie County is opposed to the use of Eminent Domain laws against private landowners as there is no benefit to general public.
