(Audubon) The Audubon City Council approved an amended ordinance during Monday’s meeting, which updates the regulations regarding building sewers and connections.
According to the ordinance, property owners are responsible for the installation, connection, and maintenance of the sewer system. Owners must compensate the City for any loss or damage resulting from the installation of the building. Additionally, all costs and expenses related to repairing any damage to City curbs or streets during the project will be borne by the property owner.
Repairs to the curb and street can only be conducted by the City or a contractor chosen by the City. Property owners must inform the Public Works Department if they need to trench through public streets or curbs, either during the initial application process or immediately upon discovering the need during installation.
The City will provide instructions regarding the specific pack and surrounding materials that the owner or contractor must use to fill the trench. However, the owner is prohibited from completing any concrete or asphalt work on the street under any circumstances. The City or its designated contractor will carry out the necessary street repairs and invoice the owner for the costs, due upon receipt.
Any violation of the owner’s responsibilities as defined in this ordinance will be subject to enforcement as outlined in the ordinance, and the owner will be held accountable for all costs and expenses needed to rectify the violation. Any sections of the ordinance that conflict with the provisions of this amended ordinance are hereby repealed. If any section, provision, or part of this ordinance is found to be invalid, unconstitutional, or unenforceable for any reason, that determination will not affect the validity or enforceability of the remaining provisions.
This ordinance is effective immediately.
