(Guthrie Center, IA) — The Guthrie County Board of Supervisors voted to pursue an ordinance against the building of the Summit Carbon Solutions pipeline in Guthrie County.
The first step towards a draft of an ordinance is the supervisors have approved the hiring of Tim Whipple of Ahlers and Cooney law firm of Des Moines. The biggest concern for the supervisors is approving an ordinance and then being sued by Summit Carbon Solutions or anybody else wanted to build a pipeline in the county. Whipple says there are a number of different ways a county can create an ordinance — through zoning issues, through drainage districts, road issues, Whipple says there is a lot to consider
Shelby and Story Counties are currently in court cases that will be heard next week says Whipple and once they are resolved, the effect of an ordinance may be known
Despite this, Supervisor Mike Dickson proposed that the Board engage in Whipple’s services to begin the process of formulating an ordinance
Whipple says there are a number of different things that an ordinance should include
The Board then voted unanimously to engage in Whipple’s services — an engagement letter will be drafted and presented to him. Dickson offered to work closely with him on drafting a potential ordinance — no timetable for completing one was given.
