(Montgomery Co.) The Montgomery County Board of Supervisors on Tuesday voted four to one to provide a $500 contribution to ISAC for the Couser vs. Shelby County friends of the court brief.
The Couser v. Shelby County case, now before the U.S. Supreme Court, centers on whether local governments can regulate pipeline routes under the Federal Pipeline Safety Act. Summit Carbon Solutions and William Couser argue the law preempts local ordinances as “safety standards,” while Shelby County contends its rules address “location and routing.” The Pipeline Safety Trust filed a brief supporting the counties, arguing federal law does not bar local control over pipeline siting.
Supervisor Bryant Amos said he has mixed feelings about this.
Supervisor Mike Olson was not in favor.
Supervisor Charla Schmid said Montgomery County is part of a whole entire state and she feels they need to support each other.
Again, the Supervisors voted four to one in favor of the $500 contribution, with Mike Olson voting No.
