(Des Moines) The Iowa Attorney General’s Office has ruled that the August 5 fatal shooting of 45-year-old David Leonard Maupin by a Des Moines County sheriff’s deputy was legally justified.
The finding follows an investigation by the Iowa Division of Criminal Investigation. Deputies were called to a rural Burlington residence after a report that Maupin, intoxicated and armed, had threatened his girlfriend and her young child.
Deputy Brett Haubrich confronted Maupin outside a garage. Authorities say Maupin ignored commands to disarm, threatened to shoot, and advanced on the deputy with a rifle before being shot. Investigators later found the loaded weapon, additional firearms, and evidence of heavy drinking. An autopsy showed Maupin’s blood-alcohol level was .30.
The Attorney General’s Office said Deputy Haubrich’s use of force was lawful and that no charges will be filed, closing the case.
